The case is Azar vs. Garza. Basically, a pregnant illegal wanted/was convinced to want an abortion. The government objected. A judge ruled that of course the baby could be killed. A panel for the Court of Appeals for DC reversed the judge. A full hearing by the DC Circuit decided to kill the kid. The government appealed to the Supreme Court, but a funny thing happened:
The details are disputed, but sometime over the course of the night both the time and nature of the appointment were changed. The doctor who had performed Doe’s earlier counseling was available to perform the abortion after all and the 7:30 a.m. appointment was moved to 4:15 a.m. At 10 a.m., Garza’s lawyers informed the Government that Doe “had the abortion this morning.”
The Supreme Court declared the case moot, as the baby is dead, and sent the case back to district court with instructions to vacate the order. This doesn’t settle the issue one way or another. The government had asked for sanctions against the opposing attorneys for lying to them but the justices apparently could not agree to do so and settled for reminding everyone to play nice in the future.
